dc.description	Within the legal sphere, the health and safety of workers is protected by several regulations and regulated through the constitution of Ecuador. Furthermore, there are several international and national regulations which protect the worker such as the Decree Executive 2393, Decision 584 Andean Instrument for Safety and Health at Work, Code of the work, ministerial and inter-ministerial agreements, general regulations of the LOSEP, regulations of local organizations. They are policies that, although many have not been implemented updated for several years now, they serve to protect the health and safety of the worker by punishing the employer who does not comply with the regulations. The constitution of Ecuador indicates that health is a fundamental pillar and declares it a right that the State must guarantee as in article 32 which also dictates the following, “This right will be linked to the exercise of other rights, among them is the right to water, food, education, physical culture, work, social security, healthy environments and others that They support good living” (Ecuador, 2008, page 18). Within article 15 of executive decree 2393 it states that the units of Safety and Hygiene those who recognize and evaluate risk, controls, generate safety programs promotion and training, record accident rates and provide technical advice in technical subjects (Cordero,	es_ES
dc.description.abstract	Dentro del ámbito legal la salud y seguridad de los trabajadores está protegida por varios reglamentos y normada a través de la constitución del Ecuador. Además, existen varios reglamentos internacionales y nacionales los cuales protegen al trabajador como lo son el Decreto ejecutivo 2393, Decisión 584 Instrumento Andino de seguridad y Salud en el Trabajo, Código del trabajo, acuerdos ministeriales e interministeriales, reglamento general de la LOSEP, reglamentaciones de organismos locales. Son políticas que a pesar de que muchas no se han actualizado ya varios años sirven para proteger la salud y seguridad del trabajador castigando al empleador que no cumpla con la normativa. La constitución del Ecuador señala que la salud es un pilar fundamental y la declara un derecho que el Estado deberá garantizar como en el artículo 32 el cual dicta además lo siguiente, “este derecho será vinculado al ejercicio de otros derechos entre ellos está el derecho al agua, alimentación, educación, cultura física, el trabajo, seguridad social, ambientes sanos y otros que sustentan el buen vivir”(Ecuador, 2008, pág. 18).
